Our privacy notice has been developed to provide you with information about our approach to data processing at Evolution Funding Ltd.
Evolution Funding Ltd changes it’s privacy notice from time to time by updating these pages – to reflect changes in our data processing and to clarify information for data subjects.
In order to clarify the different processing of personal data that we conduct, we have sub-divided our privacy notice into separate pages that deal with the data we collect from customers, about dealership proprietors, as part of our recruitment and employment process and that is used for marketing purposes.
You should check these pages periodically to ensure that you are happy with any changes that we make.
By ‘information’ we mean personal and financial information contained within the data, about data subjects, which we process.
By ‘data subjects’ we mean the person who the information contained in the data is about.
By ‘processing’ we mean anything that we do with the information including collection, sharing, storage and deletion.
By ‘Data Controller’ we mean, the entity that is responsible for determining the processing of the personal data.
By ‘Data Processor’ we mean, the entity that processes the personal data under the instruction of the data controller

Why we need to process personal data
Please follow these links for descriptions of the specific areas of personal data processing conducted by Evolution Funding Ltd.
We only process information about you that we believe is necessary for us to provide our services to you or to improve the services that we are able to offer.
CONSENT – Where you, as the data subject, provide your consent to the processing of your personal data for one or more specific purposes, you may withdraw your consent at any time.
We typically use consent as our legal basis for processing personal data where the processing is conducted in order to send communications to you about our services, to exchange information for aftersales surveys or further marketing purposes.
CONTRACT – Where you are providing your data for the services that you request from us – it is necessary for us to use your information to carry out checks for identity and suitability before we provide those services to you. In these circumstances your data is being processed as it is necessary for the purposes of entering into a contract for services that you have requested.
We would typically use this legal basis for processing your personal data in order to process an application for a vehicle loan so that you can enter into a loan agreement with one of our panel of funders.
This legal basis for processing personal data is also used when processing personal data of those who wish to enter into a contract for employment with Evolution Funding.
LEGAL OBLIGATION – There are circumstances when we are compelled by a legal obligation to process certain personal data about individuals. This is typically a legal basis for processing ‘proof of identity’ data when confirming a candidate’s right to work in the UK. This will be relevant to those applicants who have successfully completed the initial stages of the recruitment process.
LEGITIMATE PURPOSES – Data protection law also allows us to use personal information for our genuine and legitimate reasons as long as we respect your rights and freedoms. Such uses include checks for to prevent fraud and money laundering.
Legitimate interests is also our legal basis when considering the period of time to retain customer records, in order to protect the commercial interest of the company e.g. from suspected fraud or to defend against complaints for negligence.
When we rely on our legitimate interests as the legal basis for processing the information in your personal data, we will carefully consider and balance any possible effect this may have on you and your rights.
SECONDARY USE OF YOUR DATA – Additionally, some of the information that we collect may also help us develop new and improved products and services to meet our customers’ needs. If we use your data for these secondary purposes then we either obtain your consent for those purposes or anonymise the data so that it no longer contains information that can identify you.
We may also pass your data onto companies who offer additional insurance and warranty products.
There will be circumstances where we will only process your data if we have your consent to do so. For example, if you provide us with data that is classed as a special category of data such as health information, criminal records of convictions and offences, or allegations of criminal offences. We will only process this with your permission (unless we feel the processing is necessary to protect your vital interests or if the law allows us to do so). You have a right at any time to ask us to stop the processing of that specific data.

The right to erasure – this means that you can request that your personal data is deleted from our records, also referred to as ‘the right to be forgotten’.
The right to restrict how your personal information is used – this means that you have the right to object to how we use your personal information, including for direct marketing purposes.
The right to receive your personal information in a legible and transferable format – this means that you can make a reasonable request for your data to be sent to you in a format that is accessible to you.
The right to object to the use of your personal information – This right applies unless we can demonstrate compelling legitimate grounds for continuing to process your data.
Rights related to automated decision making including profiling – this means you have the right to object to your personal information being used to make a decision based on an automatic process without human intervention.

Evolution Funding Ltd is a broker and not a lender. We need to process your personal data in order to provide you with access to the vehicle finance that you are applying for.
If we do not have access to the relevant information contained in the data that you as a customer, provide either directly to us or via a third party, then we will be unable to provide the brokerage services advertised.
We will not process any information about you that we do not need in order to provide and oversee the services that you are applying for.

All the personal data we hold about you will be processed by our staff and systems in the United Kingdom. Your data will never be processed, by us or our suppliers, outside the EEA.
Your information may be passed to third parties, where required, to provide the services you have applied for, as well as where there is a legal obligation for us to provide third parties with this information e.g. The FCA or The Police, to prevent, detect, investigate and prosecute fraud, alleged fraud, money laundering and other crimes, and to confirm your identity.

We may also pass your information to our technology providers, and other selected providers of our products and services. Where it is necessary to share your personal data with other organisations, we will comply with all aspects of the General Data Protection Regulation (GDPR) and the Data Protection Act (DPA 2018).

Post-sale we may pass your information to GID who offer additional insurance and warranty products.
When we collect your personal information, the length of time we retain it is determined by the purpose for which we use that information and our legal and regulatory obligations.
Once we have established that we no longer require the information for the specified purposes for which it was collected or the purposes outlined below, we would either anonymise or delete the information. We would not retain personal information in an identifiable format for longer than is necessary.
Other determinants for the length of time that we retain your personal information are:

Once your finance is in place, you may receive a call from GID. They may contact you to discuss the retailer experience and any asset protection you may have in place.
GID have been appointed by Evolution Funding and My Car Credit to contact our customers as part of our welcome process. They are a chosen business partner who provide financial services asset protection advice.

Evolution Funding Ltd will never send customer data for processing outside of the EEA. We also work with our chosen data processors to ensure that they (and any sub-processors that they may use) have a commitment to processing personal data within the UK and the EEA.
We are committed to ensuring that your information is secure.
In order to prevent unauthorised access or disclosure we have put in place suitable physical, technological and managerial procedures to safeguard and secure the information we collect.
It is also a condition of our contracts with any data processors that they and their sub-processors have appropriate security measures in place to protect the data being processed on our behalf.
Our security measures are continually improved in line with technological developments.
Track and understand product usage
We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device’s IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf.
We use Pendo to better understand our users’ needs and to optimize this service and experience. Pendo is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Pendo uses cookies and other technologies to collect data on our users’ behaviour and their devices. Pendo collects user interactions with your applications as raw “events”. Events have some default properties, including Visitor ID, which is a unique identifier for individual end-users (visitors).
We improve our products by using Microsoft Clarity to see how you use our website. By using our site, you agree that we and Microsoft can collect and use this data. We partner with Microsoft Clarity to capture how you use and interact with our website through behavioural metrics, heatmaps, and session replay to improve products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity.
